The State Department has issued a rule for the conduct of the permanent diversity program, which follows closely the rules and procedures for the original program. To be eligible for the program, an alien must:be a native of a low-admission foreign state

have at least a high school education or its equivalent or, within the five years preceding the date of application for a visa, have two years of work experience in an occupation requiring at least two years training or experience.

The State Department has stated that aliens in the United States who meet the eligibility requirements may also apply for selection under the permanent diversity program; such aliens need not be in lawful status to apply.Aliens within the United States were also eligible for the program. Some of these aliens may also be eligible to apply for adjustment of status if they are selected for participation in the DV-1 program.
