The key requirement imposed on health care facilities by INRA was
the labor attestation requirement, through which the facility needed
to affirm that it was taking specific, enumerated steps to recruit
U.S. workers, train the U.S. workers, and improve nursing wages and
working conditions. ? 212(m) of the INA, 8 U.S.C. ? 1182 (m). By the
time that the H-1A category expired on August 31, 1995, health care
facilities had made substantial reductions in their reliance on
foreign nurses. Because of the apparent success of the five-year
program in reducing the number of foreign nurses at U.S. facilities,
there was little continued need for the complex regulatory
requirements imposed by the H-1A category. |
